Expungement Eligibility for Virginia Beach Criminal Records

Virginia expungement law provides a procedure for removing eligible police and court records associated with criminal charges and certain other matters.

As of September 2026, Virginia Code § 19.2-392.2 generally permits a person to petition for expungement when a criminal charge:

  • Resulted in an acquittal;
  • Was nolle prosequi;
  • Was otherwise dismissed under circumstances qualifying for expungement; or
  • Falls within another category expressly made eligible under Virginia law.

Eligibility should not be determined merely by looking at a Virginia Beach docket entry that says “dismissed.” The exact disposition, plea, factual findings, deferred-disposition procedure, and final order may determine whether traditional expungement is available.

Virginia’s expungement statute is also scheduled to change effective December 1, 2026. The revised statute generally describes eligible nonconviction matters more broadly while continuing to distinguish deferred dispositions involving a stipulation or finding of facts sufficient for guilt. The law in effect when relief is sought should therefore be reviewed together with the actual Virginia Beach court record.

Acquittal, Nolle Prosequi and Dismissed Virginia Beach Charges

Traditional Virginia expungement has primarily provided relief for criminal charges that did not result in a conviction.

An acquittal occurs when the defendant is found not guilty.

A nolle prosequi occurs when the Commonwealth elects not to prosecute the charge further at that time. A nolle prosequi does not itself constitute a conviction and can provide a basis for seeking expungement under § 19.2-392.2.

A charge that is otherwise dismissed may also qualify, but the precise reason and procedure by which the case was dismissed can matter.

The final Virginia Beach court order should therefore be obtained and reviewed before concluding that a particular charge is or is not eligible for expungement.

What Does “Otherwise Dismissed” Mean for Virginia Beach Expungement?

Virginia Beach expungement lawyer reviewing an otherwise dismissed criminal chargeVirginia’s expungement statute has long used the phrase “otherwise dismissed.” The phrase is important because not every dismissal has the same legal effect for expungement purposes. A dismissal that occurs without a finding or stipulation that the evidence was sufficient to establish guilt can present a materially different expungement issue from a deferred disposition in which the court first finds facts sufficient for guilt and later dismisses the charge after conditions are completed. The defense record, transcript where available, plea documents, and final disposition order may therefore be important when determining whether a Virginia Beach dismissal qualifies.

Deferred Dispositions and Virginia Beach Expungement Eligibility

Virginia Beach expungement lawyer reviewing a deferred dismissalA deferred disposition requires separate analysis because some dismissed cases involve a plea, stipulation, or judicial finding concerning facts sufficient to establish guilt before final dismissal. Virginia Code § 19.2-298.02 can permit an eligible dismissal to be treated as “otherwise dismissed” for expungement purposes when the statutory requirements are satisfied and the parties’ agreement concerning expungement eligibility is reflected in the final disposition. Other first-offender or deferred-disposition statutes may lead to dismissal without making the resulting record eligible for traditional expungement. Virginia’s newer record-sealing laws may provide a different form of relief for some deferred-and-dismissed Virginia Beach cases that are not expungeable. The exact statute used in the original case and the language of the Virginia Beach court order should therefore be reviewed carefully.

Virginia Beach Circuit Court Expungement Process

Virginia Beach Circuit Court Expungement ProcessA petition seeking expungement of an eligible Virginia Beach criminal charge is generally filed in the Virginia Beach Circuit Court. The Circuit Court is part of Virginia’s Second Judicial Circuit and is located at 2425 Nimmo Parkway in the Virginia Beach Judicial Complex. The original criminal case may have been resolved in Virginia Beach General District Court, Virginia Beach Juvenile and Domestic Relations District Court, or Virginia Beach Circuit Court depending on the nature of the charge and case. The expungement proceeding itself is handled in Circuit Court when the statutory filing requirements are satisfied. The petition must identify the criminal record to be expunged and provide the information necessary for the court, Commonwealth, and law-enforcement agencies to evaluate the request. Filing the petition begins the process, but it does not automatically result in expungement.

The petition and supporting records may require information concerning:

  • The criminal charge to be expunged;
  • The date and final disposition of the case;
  • The Virginia Beach court in which the original matter was resolved;
  • The arresting law-enforcement agency;
  • The petitioner’s identifying information;
  • The Virginia criminal history record;
  • The legal basis for expungement; and
  • Any objection or response filed by the Commonwealth.

The Virginia Beach Circuit Court ultimately determines whether the statutory requirements for expungement have been satisfied.

Can the Virginia Beach Commonwealth’s Attorney Object to Expungement?

Virginia Beach expungement lawyer addressing manifest injustice in Circuit CourtYes. Virginia’s expungement procedure permits the Commonwealth to participate in the proceeding and, depending on the case, oppose the petition. An objection does not automatically mean that the petition will be denied. The Virginia Beach Circuit Court judge ultimately determines whether the requirements for expungement have been established. The issues may include the final disposition, prior criminal history, statutory eligibility, and—where the applicable version of § 19.2-392.2 requires it—whether continued existence and dissemination of the arrest information causes or may cause a manifest injustice. The underlying records should be reviewed before filing so that foreseeable eligibility or evidentiary issues can be addressed as part of the petition. Beginning December 1, 2026, the revised version of § 19.2-392.2 uses a potential manifest injustice standard and expressly provides that the existence of a prior conviction alone is not sufficient grounds to deny an expungement.

Expungement and Record Sealing Are Different

Virginia Beach expungement lawyer explaining expungement and record sealingExpungement and record sealing are separate forms of Virginia criminal record relief. Although both can limit access to a criminal record, they apply under different statutes, have different eligibility requirements, and can provide different forms of relief. A Virginia Beach criminal record that does not qualify for traditional expungement may still qualify for sealing under Virginia’s newer record-sealing laws. Expungement generally concerns eligible records associated with charges that did not result in a conviction and is governed by Virginia’s expungement statutes. Record sealing restricts access to eligible criminal-history and court records under Virginia’s separate sealing statutes. The newer sealing system can apply to some records that cannot be traditionally expunged, including certain convictions and deferred-and-dismissed dispositions. Some records may qualify for automatic sealing, while others require a petition in Circuit Court. Virginia Code § 19.2-392.12 permits petitions to seal certain eligible misdemeanors, Class 5 or Class 6 felonies, qualifying larceny offenses, and deferred-and-dismissed charges. If your Virginia Beach record is not eligible for traditional expungement but may qualify under Virginia’s sealing laws, see our Virginia Record Sealing Lawyer page.

Virginia Clean Slate and Virginia Beach Criminal Records

Virginia’s Clean Slate system provides automatic and petition-based procedures for sealing certain eligible criminal records. Clean Slate is not simply another name for expungement, and a Virginia Beach criminal record may need to be evaluated under more than one record-relief statute to determine which form of relief, if any, applies.

A Virginia Beach criminal record may:

  • Qualify for traditional expungement;
  • Qualify for automatic sealing;
  • Require a petition for sealing;
  • Qualify under more than one record-relief provision; or
  • Not qualify for relief under the applicable statutes.

Eligibility can depend on the exact offense, final disposition, offense date, criminal history, waiting periods, and statutory exclusions.

Virginia’s automatic-sealing provisions are limited. They do not mean that every misdemeanor, every dismissed charge, or every old conviction will automatically disappear.

Petition-based sealing under § 19.2-392.12 also has separate eligibility requirements, including statutory offense restrictions and, for qualifying offenses, conviction-free waiting periods that are generally seven years for misdemeanors and 10 years for felonies.

If the issue is whether Virginia’s Clean Slate provisions should seal a record or whether additional action is necessary, see our Virginia Clean Slate Lawyer page.

What Expungement Can Do for a Virginia Beach Criminal Record

Virginia Beach petition to expunge eligible police and court recordsA criminal record can affect employment, professional licensing, education, housing, military opportunities, security clearances, and private background checks even when the underlying criminal charge was dismissed. Virginia Beach’s substantial military and federal presence can make criminal-record issues particularly important for people whose employment, military service, contracting work, professional licensing, or security responsibilities involve background investigations. Virginia law restricts employers and educational institutions from requiring an applicant to disclose information concerning a criminal matter that has been expunged. State and local governmental agencies are subject to similar statutory restrictions in specified licensing, permitting, registration, and governmental-service situations. An expungement order addresses the official police and court records covered by the order. Private background-reporting companies that previously obtained information while the record was publicly available may present separate practical issues after an expungement is entered. An official expungement order does not necessarily mean that every privately maintained database will update immediately.

What to Send a Virginia Beach Expungement Lawyer

The most useful starting point for a Virginia Beach expungement review is the actual court record. The exact charge, final disposition, and procedure used to resolve the case can determine whether traditional expungement is available or whether another form of record relief should be considered.

A docket description or private background report may not contain enough information to determine eligibility. When available, the final Virginia Beach court order and original charging documents can provide important information about how the case was resolved.

Helpful information may include:

  • The original warrant, summons, indictment, or charging document;
  • The final Virginia Beach court disposition or order;
  • The charge and Virginia Code section;
  • The original case number;
  • The date of arrest or charge;
  • Information concerning the arresting law-enforcement agency;
  • Any plea agreement or deferred-disposition paperwork;
  • Any prior expungement or sealing orders;
  • A criminal history record, if already available; and
  • Any documents showing why the continued record is causing a problem.

The exact final disposition is particularly important. A case described simply as “dismissed” may require review of the final order, plea documents, or other court records to determine whether it qualifies for expungement under Virginia law.

Frequently Asked Questions About Virginia Beach Expungement

Can a Virginia Beach criminal charge be expunged?

A Virginia Beach criminal charge may qualify for expungement when it falls within Virginia’s expungement statutes. Acquittals, nolle prosequi dispositions, and certain qualifying dismissals are common examples, but eligibility depends on the exact final disposition and applicable law.

Where is a Virginia Beach expungement petition filed?

A petition concerning an eligible Virginia Beach criminal charge is generally filed in Virginia Beach Circuit Court.

Is a nolle prosequi eligible for expungement?

A nolle prosequi is one of the dispositions expressly addressed by Virginia’s expungement statute and can provide a basis for seeking expungement when the statutory requirements are satisfied.

Does every dismissed charge qualify for expungement?

No. The reason and procedure by which the charge was dismissed can matter. Deferred dispositions involving a plea, stipulation, or finding of facts sufficient for guilt may be treated differently from a dismissal that occurred without such a finding.

Can the Virginia Beach Commonwealth’s Attorney object to an expungement?

Yes. The Commonwealth may respond to or oppose a petition. An objection does not automatically require denial; the Virginia Beach Circuit Court determines whether the statutory requirements for expungement have been established.

Is record sealing the same as expungement?

No. Virginia has separate expungement and record-sealing statutes. Expungement generally concerns eligible nonconviction records, while sealing can apply to additional categories of records, including some eligible convictions and deferred dismissals.

Can a criminal conviction be expunged in Virginia?

Ordinary expungement and record sealing should not be confused. Some convictions may qualify for record sealing even though traditional expungement is not the applicable remedy. Certain exceptional circumstances, including qualifying pardons or convictions vacated under specified statutes, are separately addressed by Virginia’s expungement law.

What is Virginia Clean Slate?

Clean Slate is Virginia’s newer record-sealing framework. It includes automatic and petition-based procedures for eligible criminal records and is separate from traditional expungement.

Can an expunged record still appear on a private background check?

It can happen when a private background-reporting company previously collected information before the official record was expunged. An expungement order governs the official records covered by the order, while private reporting issues may require separate attention.

How do I know whether I need expungement or record sealing?

The answer depends on the exact charge, final disposition, any plea or factual finding, criminal history, offense date, and the statutory provision that applies. Reviewing the original Virginia Beach court record is usually the best starting point.
